Equitrans has limited flexibility to manage imbalances on its Gathering System, Mainline Transmission System, the Sunrise Transmission System and the
Allegheny Valley Connector.
Effective immediately, Equitrans is requesting that its customers take immediate action to keep any over-deliveries or under-takes in line with scheduled
quantities. This action is required regardless of accumulated imbalance positions and is requested to avoid issuance of an OFO.
This action is pursuant to Sections 6.11 and 6.12 of the General Terms and Conditions of Equitrans’ FERC Gas Tariff. If Customer and/or Customer’s
operator fails to comply with the terms of this OFO, such Customer shall be subject to (1) liability for any damages including, but not limited to, direct,
consequential, exemplary, or punitive dames incurred by Equitrans or any other party as a result of such failure, (2) a penalty of $25 per Dth times the
quantity of gas by which the Customer deviated from the requirements of this OFO, (3) flow control, and/or (4) a reduction in scheduled quantities to match
flowing gas. In addition, Equitrans will not permit post-cycle adjustments to avoid an OFO penalty.
