Pursuant to Rule 207 of the Rules of Practice and Procedure of the Federal Energy Regulatory Commission
(“Commission”), Kinetica Deepwater Express, LLC (“KDE”) submitted for filing a Petition for Approval of
Stipulation and Agreement. KDE is also filed the accompanying Stipulation and Agreement with Schedules
1, 2, and 3 for the Commission’s approval. KDE submitted the Stipulation and Agreement on behalf of
itself and the parties listed in Schedule 1. Schedule 2 contains clean and marked versions of the pro forma
tariff records affected by the Stipulation and Agreement. Schedule 3 sets forth the applicable
depreciation, negative salvage, and intangible amortization rates on the KDE system. The Settlement
provides that KDE will seek authority to implement the Settlement rates effective as of November 1, 2023.
As a result, KDE asked the Commission to grant the petition and approve the Stipulation and Agreement
on or before September 15, 2023.
