Notice Text:
Equitrans L.P. (Equitrans Gathering) is providing notice of an unplanned pipeline outage in the Smithburg Operational Area, impacting producers in the
Equitrans Gathering System.
In response to this outage, Equitrans L.P. is issuing an OFO effective Friday, November 4, 2022, at 10:00 AM ET and until further notice for producers in the
Smithburg Operational Area in accordance with Sections 5.9[2.6] and 6.11 of its FERC Gas Tariff.
During this outage, producers in the Smithburg Operational Area, without current contractual gathering on-system delivery capability, must shut-in flowing
production by Friday, November 4, 2022, at 10:00 AM ET or secure alternative on-system market. Customers securing alternative markets must coordinate
with ETRN Commercial Services for approval.
Equitrans L.P. will notify impacted parties for specific meters required to be shut in.
Customers should adjust Nominated Quantities accordingly.
If Customer and/or Customer’s operator fails to comply with the terms of this OFO, such Customer shall be subject to (1) liability for any damages including,
but not limited to, direct, consequential, exemplary, or punitive damages incurred by Equitrans or any other party as a result of such failure, (2) a penalty of
$25 per Dth times the quantity of gas by which the Customer deviated from the requirements of this OFO, (3) flow control, (4) a reduction in scheduled
quantities to match flowing gas and/or (5) retainage of the thermally equivalent quantities of natural gas volumes flowed during the OFO period. Equitrans
will not permit post-cycle adjustments to avoid an OFO penalty.
Upon completion of the outage, the OFO will expire, and Equitrans L.P. will notify impacted parties when they can turn back in-line.
Customers should monitor Equitrans’ Informational Postings website for updates to this notice.
